Notice of the Supreme People's Court on Issues Pertaining to the Application of the Arbitration Law of the People's Republic of China
各省、自治区、直辖市高级人民法院：
Higher people's courts of all provinces, autonomous regions, and municipalities directly under the Central Government:
…当事人双方书面协议放弃仲裁后，一方向人民法院起诉的，人民法院应当依法受理。二、在仲裁过程中，当事人申请财产保全的，一般案件由被申请人住所地或者财产所在地的基层人民法院作出裁定；属涉外仲裁案件的，依据《中华人民共和国民事诉讼法》第二百五十八条的规定，由被申请人住所地或者财产所在地的中级人民法院作出裁定。
…Where either disputing party files a lawsuit with a people's court of competent jurisdiction after both disputing parties agree on a waiver of arbitration in writing, the people's court shall admit the case according to law. II. Where either disputing party files a petition for preservation of property during the course of the arbitration, an order shall be made by the lowest people's court in the jurisdiction where the domicile or property of the party against whom the petition is filed is located in the case of a domestic arbitration case, or by the intermediate people's court in the jurisdiction where the domicile or property of the party against whom the petition is filed in accordance with Article 258 of the Civil Procedure Law of the People's Republic of China in the case of an international arbitration case.
