1. The remedies of the Parties under this Agreement are cumulative and shall not exclude any other remedies to which the Party may be lawfully entitled.

        2. Subject to Section 6 of the General Terms and Conditions, the rights and remedies herein provided are cumulative and are not exclusive of any rights or remedies that any Party may otherwise have at law or in equity.

        3. Provided that where different rights are created as a result of or on account of a single cause of action, where a Party has achieved complete remedy by pursuing one course of action, such Party shall not be entitled to pursue other causes of action to seek further remedies for the same cause of action.

        4. Thus, in addition to any other rights or remedies, all of which shall be deemed cumulative, Party A and Party B and/or their respective affiliates, as applicable, shall be entitled to obtain injunctive relief to enforce the terms of this Section.

        5. Termination or expiry of this agreement shall not affect any rights, remedies, obligations or liabilities of the parties that have accrued up to the date of termination or expiry, including the right to claim damages in respect of any breach of the agreement which existed at or before the date of termination or expiry.

        6. All rights and remedies of Party A described herein shall be cumulative and not restrictive of any other rights or remedies available under any other document or instrument, at law or in equity.

        7. The foregoing remedies provided for in Section 3.5(a) are cumulative and in addition to and not in limitation of any other right or remedy of the Partnership provided by law or under this Agreement.

        8. Subject to the provisions of Article X and except as may otherwise be set forth in this Agreement, remedies are cumulative, and the exercise of, or failure to exercise, one or more of them by a Party shall not limit or preclude the exercise of, or constitute a waiver of, other remedies by such Party.

        9. Any and all remedies herein expressly conferred upon a party will be deemed cumulative with and not exclusive of any other remedy conferred hereby, or by law or equity upon such party, and the exercise by a party of any one remedy will not preclude the exercise of any other remedy and nothing in this Agreement shall be deemed a waiver by any party of any right to specific performance or injunctive relief.

        10. If any one shareholder has given such a notice, then every shareholder entitled to vote may cumulate votes for candidates in nomination.
