Off-site Regulatory Rules for Financial Leasing Companies

 
第三条银保监会负责制定统一的融资租赁公司非现场监管规则和监管报表,督促指导各地方金融监管部门开展非现场监管工作,加强监管信息共享。
Article 3: The CBRC shall be responsible for formulating unified off-site regulatory rules and regulatory statements for financial leasing companies, supervising and guiding local financial regulatory authorities in off-site regulation, and improving the sharing of regulatory information.

第五条 地方金融监管部门在对本地区融资租赁公司实施非现场监管时,应当坚持风险为本原则,持续全面识别、监测、评估融资租赁公司风险状况。
Article 5: In the off-site regulation of the financial leasing companies within its jurisdiction, any local financial regulatory authority shall focus on the risks and continuously and comprehensively identify, monitor and evaluate the risk status of the financial leasing companies.

第十六条 各地方金融监管部门应当加大对融资租赁公司信用风险、流动性风险的监督检查力度。结合其他监管手段,认真核实融资租赁公司资产质量和风险,重点核查租赁物是否符合监管要求、是否存在违法违规融资、不良资产是否如实反映、业务集中度和关联度是否超标等情况。

Article 16: Each local financial regulatory authority shall effectively improve the supervision and inspection of the credit risks and liquidity risks of the financial leasing companies. In combination with other regulatory means, each local financial regulatory authority shall carefully verify the quality and risks of the assets of each financial leasing company, focusing on whether the leased assets are in compliance with the regulatory requirements, whether there is any illegal financing, whether the non-performing assets are truthfully reflected, and whether its business concentration or relevance is non-compliant, etc.

第二十二条 各地方金融监管部门应当建立非现场监管与现场检查等的联动监管机制,将非现场监管分析评估结果作为现场检查、分类监管的重要参考,适时采取相应的监管措施,指导融资租赁公司提高风险管理水平,切实防范化解风险。
Article 22: Local financial regulatory authorities shall establish a linkage regulation mechanism of off-site regulation and on-site inspection, use the results of the analysis and evaluation of off-site regulation as an important reference for on-site inspection and response based on classification, take corresponding regulatory measures in due time, guide financial leasing companies in improving their ability in risk management, and effectively prevent and respond to risks.
