Judgment和decree这两个词在翻译中经常都被翻译成“判决、判决书”。有些法律中使用judgment一词，有些则使用decree，这种用法通常是没有问题的，因为一般经过法庭审理后仅制作一份判决书，所以使用这两个词中的任何一个都可以。
本文中仅讨论这两个词在印度和巴基斯坦法律中的不同用法。由于历史问题，印巴两国的法律大同小异，两国法律中对这两个词的定义和用法也基本一致。
 
        1、judgment的定义和翻译
        两国法律中对judgment和decree的定义完全相同：
        “Judgment” means the statement given by the Judge of the grounds of a decree or order:
        根据这一定义，judgment一词是指法官对作出判决书或者裁定书的理由陈述，因此可以翻译为“裁判理由书”。
 
        2、decree的定义和翻译
        “Decree” means the formal expression of an adjudication which, so far as regards the Court expressing it, conclusively determines the rights of the parties with regard to all or any of the matters in controversy in the suit and may be either preliminary or final.
        根据这一定义，decree一词是指法官对当事人实体权利作出裁判的正式表述，与一般意义上的“判决书”相似，一词可以翻译为“判决书”。
