1. If the provision of Service and Warranty Work for the Service Productsand/or Contractual Products is not performed by Customer itself, then it has to be ensuredby the Customer that such provision of Service and Warranty Work for the Service Products and/or Contractual Productswill be performed in full compliance with the terms and conditions of this Agreementby qualified and trained persons ofCustomer’s Sales Companies and/or specialized after-sales services providers under Customer’s responsibility, based on agreements concluded with such Customer’s Sales Companies and/or specialized after-sales services providers.

        2. Except as otherwise agreed herein with respect to the provision of Service and Warranty Work for the Service Products and/or Contractual Products by or through the Customer, the latter shall not be entitled to assign its rights or obligations under this Agreement, may it be in whole or in part, to Third Parties without having received AAA’s prior written approval to this effect.

        3. As soon as the Customer discovers defects on delivery or hidden defects during the assembly process, the Customer shall notify AAA of these defects by submitting a claim no later than four weeks after the defect detection.

        4. The Customer shall be obliged to use the Service Products supplied to Customer exclusively in connection with the inspection, maintenance, repair and replacement of Contractual Products in accordance with the provisions of this Agreement.

        5. The Customer shall be only entitled to actively sell Service Products to its customer service network, and he agrees and accepts that the active sale of Service Products to individuals and companies that are not part of the customer service network shall not be allowed.

        6. The Customer undertakes to purchase Service Products in connection with the inspection, maintenance, repair and replacement of Contractual Products in accordance with the provisions of this Agreement exclusively from AAA or to use service products of at least comparable quality within AAA specifications.

        7. By the 5th of each calendar month ("Reporting Month"), the Customer shall provide AAA with an overview of the spare parts intended to be purchased by the Customer via collective orders in the 12 (twelve) months following the Reporting Month via EDI (Electronic Data Interface) or alternatively via electronic media (such as e-mail) ("Forecast").

        9. All special tools required for the inspection, maintenance, repair and replacement of Contractual Products shall be obtained by the Customer at its own expense from AAA on the basis of the identification number.

        10. Customer shall be obliged to train their own service organization unless otherwise agreed for service works on the Contractual Products or Service Products and to provide AAA with documentation of these trainings, upon request.
