3. Commencing from the commercial production of gold and associated mineral, the governmental owns and posses a loyalty of (5%) per annum of total quantity of the pure gold, pure, and produced associated minerals during Exploitation term including any extended term.

5. The second term shall be two years and the third term shall be two years, it shall depend on the choice of Contractor under a notice in writing that the company sends thirty days before the expiry date of current period without any condition otherwise the fulfillment of undertakings stated in the previous periods.

6. Contractor may choose the period under a written request that Contractor sends to the company six months before the expiry of Exploitation term, based on technical studies, it shall include the estimation of production period, and the expected production rates during extended period, Contractor’s obligations and economic considerations.

7. Contractor may dig water wells in the exploration area on his own expense and utilize thereof in exploration and Exploitation operations of this contract without charge. Contractor may ask for extensions of the workspace in case that there are extensions of the gold outside areas and inside the area of North Garf upon the consent of the company.

8. After executing the Exploitation contract, the Exploitation operations shall commence immediately by Contractor under the supervision of the company that takeovers the same according to proper mining rules and acceptable engineering principles and until such operations in the mine are deemed completed.

9. After a commercial discovery is achieved by Contractor in the area, Contractor may keep some parts of the area “keeping areas that may have potential reserves” and proceed in exploration and estimation detailed processes in order to maximize the value of reserves and promote thereof to the grade that may achieve a commercial discovery.

10. The Contractor shall commence the exploration work under this Contract from the date of the Area delivery to the Contractor and after obtaining all necessary permits and approvals to start the execution of works. The Company shall allow the Contractor, upon its request, to use all geological, exploratory and mining data in its possession for the Area as long as the Company has this right. The Company shall, upon request from the Contractor and not exceeding the Effective Date, allow the Contractor to use all geological information, including scientific exploration and production data available to the Company, if any, in connection with the Area in order to enable the Contractor to develop work program and budget for the initial exploration period.
